Savvy Navvy Terms of Service.

We know you don’t like reading small legal print, but there are some things we must tell you and others to which you must agree. We’ve tried to be brief - here goes:

Accepting the terms

This bit is easy: by completing our registration process and creating an account with Savvy Navvy, you acknowledge you have read and agree with these terms. If you do not agree with these terms, you are not permitted to use our service.

We may change these terms of service from time to time to respond to changes in the law, to meet supplier requirements or due to changes in the service itself. We will of course notify you of any changes in advance.

Please do tell us about anything that concerns you in the terms, as we are always looking for ways to improve.

The service

The Savvy Navvy service (“the service”) is an aid to navigation and passage planning. You must be at least 13 years old to sign up to our service.

Our chart, weather and other data sources may change over time. Some parts of the service may occasionally not be available due to circumstances beyond our control. We will be adding to and updating the features, look-and-feel and data content of the service during your subscription period, so expect to see changes! We do our best to test our online service on as many devices and operating systems as is practical, but we cannot guarantee that our service will work on any specific device. If you do encounter problems, please let us know.

The Internet

In order to work properly the service needs at least occasional internet access. The service does not include the cost of internet access.

Do not solely rely on Savvy Navvy

Ok, this bit is important. Savvy Navvy uses and displays some chart data, but we are not a substitute for official charts. You must follow local rules regarding charts and other equipment requirements wherever you are sailing. You should be prepared for loss of service access, loss of battery power, your device getting wet or otherwise failing to work, or even for it to go over the side. You must also be aware of the limitations of GPS geolocation. Please be vigilant and exercise common sense at all times. We can make navigation easier for you, but that doesn’t mean you shouldn’t be prepared for the worst.

Seriously…

The previous point really is important. So for the avoidance of doubt, you use our service at your own risk. Savvy Navvy accepts no liability for direct, indirect or consequential losses, loss or damage caused by civil wrongs, tort or negligence, inability to access the service, including but not limited to, bodily injury arising from the use of the service, reliance on the service for navigation or planning, getting hit by flying fish, navigational errors, late arrival or departure of chartered vessels or wasted time, running aground or any damage to any boat or other watercraft whatsoever, epidemics or pandemics, adverse weather conditions, errors in route planning or defects and/or errors in the data upon which the service is based.

We are not liable for losses of holiday fees or opportunity, anticipated savings, goodwill or reputation, tangible or intangible property. All route recommendations are provided “as-is” without warranty of any kind.

Our agreement with you is governed by the laws of England and Wales.

Payment

We may offer a free subscription plan in some locations. Other subscription plans may offer additional features which require payment. As the service grows and our data sources change, we may need to change the amount or structure of our charges from time to time, including in specific geographical locations. If this happens we will ensure you are notified in advance. You cannot access the paid part of the service if you have not paid in full, so please ensure your credit card is up to date. We use billing service providers to collect payment, and if they manage your subscription or collect payment, their terms of service will apply.

Your account and security

In order to use Savvy Navvy you will need to register for a Savvy Navvy account, which includes selecting a password. It is your responsibility to keep this password safe and secure. You are also responsible for any information posted on your account or as comments on our social media or online systems. Never share your password with anyone, including us. We will never ask for your password for any reason - including if we are offering support. Although you may access your Savvy Navvy account via multiple devices, we reserve the right to place limits on this facility, including limiting the number of simultaneous active logins to your account.

Personal information

To improve our service, we track some of your activity to analyse how our service is being used. To understand how we use this data, please see our Privacy Policy.

Using Savvy Navvy

We grant you permission to use Savvy Navvy for your personal use only. You may not share your account with anyone. You may not make copies, alter, decompile, disassemble or reverse-engineer our software, or attempt to bypass the access or payment systems. If you do manage to reverse-engineer our software, drop us a line: if we don’t sue you, we might want to hire you ;-).

You may not remove or obscure any copyright or trademark notices from the service. You may not copy, sell, trade or resell any of the data or services we provide to you.

Being obnoxious

It is a shame that we still have to say this, but we will not tolerate any discriminatory or otherwise objectionable content to be posted, shared or otherwise made public via the service or on our social media pages. This includes but is not limited to discrimination on the basis of race, national or ethnic origin, age, religion, disability, gender, gender expression or gender preference, as well as harmful, threatening, inflammatory, harassing, vulgar, unlawful, defamatory, infringing, abusive, obscene, fraudulent, or privacy invasive content. Savvy Navvy will not discriminate against you if you exercise your right to opt out of providing personal information for use in performance management or for resale, or request us to delete your account.  

We retain the right to suspend your account and remove any content without further notice if we deem it to be unlawful and/or in violation of this agreement.

Termination

You have the right to cancel your membership at any time. This will take effect at the end of your current payment cycle. If you signed up via the Apple app store or Google Play, your termination rights will be governed by their store policies.

We reserve the right to terminate your membership without reason at any given time.

Keeping our Terms of Service up to date

As the Savvy Navvy service grows and governing laws change from time to time, we will occasionally need to update these Terms. We will give you notice via the service or via email so that you can review the new Terms of Service. If they are not acceptable to you, you may stop using our service and request us to delete your account. Continued usage of the service will mean you have accepted the new Terms and have agreed to be bound by them.

Copyright licences and acknowledgements

The Savvy Navvy service uses data from many sources, most of which have asked us to pass on important licence or other information that they want you to know.
We keep that information here: Third Party notices. The sources and the text will change from time to time. Please read it carefully.
